By creating an account, downloading the application, or otherwise accessing or using GuardSafely ("the Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and GuardSafely.
GuardSafely is an end-to-end encrypted family location tracking application. The Service provides real-time GPS tracking, geofence zone alerts, safe space monitoring, voice messaging, photo check-ins, SOS alerts, and related family safety features via mobile applications (Android, iOS) and web interfaces. The Service is designed for families and households and is not intended for commercial surveillance, fleet tracking, employee monitoring, or any non-family use.
You must be at least 18 years of age to create a parent/guardian account. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. Child device accounts may only be created by a parent or legal guardian for minor children in their custody or care. You may also create temporary access for babysitters, grandparents, or other trusted caregivers using the babysitter mode feature.
You are responsible for maintaining the confidentiality of your account credentials, including your email, password, and family encryption keys. You are responsible for all activity that occurs under your account. You agree to immediately notify us at hello@guardsafely.com if you suspect unauthorized access to your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
You agree to use GuardSafely only for lawful purposes. Specifically, you agree that:
Violation of this section may result in immediate account termination and may be reported to law enforcement.
Free trial: New accounts receive a 30-day free trial with full access to all features. Your payment method is collected at signup but not charged during the trial. If you cancel before the trial ends, you will not be charged. If you do not cancel, your subscription begins automatically.
Standard plan: $4.99/month. Subscriptions are processed through Stripe and renew automatically unless cancelled before the renewal date.
Community Access: GuardSafely offers a free tier for families receiving government assistance (SNAP, WIC, Medicaid, Section 8, SSI, SSDI, TANF, CHIP, Free/Reduced School Lunch, LIHEAP, or similar programs). Community Access provides full access to all features at no cost. This program operates on an honor system; no documentation or verification is required.
Cancellation: You may cancel your subscription at any time through the app settings or via the Stripe billing portal. Upon cancellation, you retain access through the end of your current billing period. No partial refunds are issued for unused time. See our Cancellation Policy for details.
GuardSafely uses AES-256-GCM end-to-end encryption for all location data, voice messages, photos, and geofence configurations. Encryption keys are generated on your device and derived from a per-family secret using PBKDF2 with a random salt. Keys rotate automatically every 24 hours. Your encrypted data is stored on our servers as opaque ciphertext. We cannot decrypt, read, or access your encrypted data. You retain full ownership of all data you create through the Service.
The Service, including its design, code, graphics, logos, and trademarks, is the property of GuardSafely and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial family safety purposes. You may not copy, modify, distribute, sell, or lease any part of the Service without prior written consent.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
GuardSafely is not an emergency service. The Service should not be relied upon as a sole emergency safety tool. In an emergency, call 911 or your local emergency number. GPS accuracy depends on device hardware, satellite visibility, and environmental conditions. Location data may be delayed, inaccurate, or unavailable due to factors outside our control, including but not limited to device settings, network conditions, and GPS signal strength.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GUARDSAFELY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless GuardSafely, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
You may delete your account at any time through the app settings. Upon deletion, all your data (including encrypted location history, profiles, zones, spaces, voice messages, and notifications) is permanently removed from our servers. We may terminate or suspend your account immediately, without prior notice, if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to other users, us, or third parties.
These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law provisions. Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in the State of Ohio under the rules of the American Arbitration Association, except that either party may seek injunctive relief in any court of competent jurisdiction.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before the changes take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service and delete your account.
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy and Cancellation Policy, constitute the entire agreement between you and GuardSafely regarding the Service and supersede all prior agreements, understandings, and communications.
